Microsoft Case Sent to Court of Appeals No Fast Track for DOJ Case Byron Alley
On Tuesday the Supreme Court announced that it would not be hearing the Department of Justice antitrust case against Microsoft before the court of appeals. This represented a minor win for the software company, allowing it at least a year before being broken up.
The Department of Justice (DOJ) had requested that the Supreme Court invoke a special law allowing issues of national importance to be sent directly to the Supreme Court. In a nearly unanimous decision, the request was denied and the case sent back to the court of appeals.
